Cinnabon Sues Vape Company for Trademark Infringement

[dropcap class=”kp-dropcap”]T[/dropcap]he popular cinnamon roll company Cinnabon is suing a Las Vegas, Nevada-based vape pen company for using its name as a flavor of vape pen.

According to the Las Vegas Review-Journal, the food court dessert company is taking LiquidChronic.com LLC to court for describing its products as having a “Cinnabon” flavor.

The Cinnabon company explained that it has licensed its name to alcohol, baking mixes and other products, but never agreed to allow LiquidChronic to use the name for the “Cinnabon” flavored e-cigarette liquids and CBD-infused products that LiquidChronic sells bearing that name. Cinnabon claims that the vaping product is “targeting consumers which are familiar with” the well-known cinnamon rolls, and that this use “is likely to tarnish the Cinnabon Mark and cause a blurring in the minds of consumers.” There is also concern that Cinnabon’s name being used in the cannabis space will attract minors.

Cinnabon also claimed the company made several attempts to ask LiquidChronic to stop using the trademark on the specific products, including three separate letters sent between February and June, that did not receive a response. However, those representing Cinnabon declined to make a comment to Review-Journal.

This isn’t the first time that a cannabis company has come under fire for using a trademarked logo or name. It happened two years ago when super glue company Gorilla Glue Co. targeted products that were using its name. Similar lawsuits and disputes have occurred over the years, involving major companies such as The Hershey Company.

The vaping industry, whether it concerns cannabis-infused or non cannabis-infused, has led to a lot of quick decisions to ban its use by consumers. The Centers for Disease Control and Prevention states that 1,299 cases of EVALI have been documented as of October 18, with 33 deaths so far.
